TLNT, Inc., d/b/a LÜK (collectively, "LÜK," "LÜK Network," "we," "us," or "our") know that privacy is very important to you. We have created this privacy policy (the "Privacy Policy") to describe what kinds of personal information we may obtain through:
  • Our Site located at https://www.luknetwork.com/ (the "Site");
  • Any other Site, mobile application, or digital property that links to this Privacy Policy; and
  • When you interact with us in any other way.
By accessing or using the Site or any other Site, web application, or digital property that links to this Privacy Policy (collectively, the "Digital Properties"), you may access our proprietary platform (the "Platform"), and (i) register with us as a Client ("Client"), open an account ("Client Account"), and use our professional services for talent casting and booking; or (ii) register with us as a Talent Agency, open an account ("Agency Account"), and use our professional services to identify opportunities, book and confirm talent (collectively, the "Services"); or (iii) register with us as a Talent, open an account ("Talent Account"), and use our professional services for payout processing. If you are under the age of 18, you may not use our Services.
By accepting this Privacy Policy, accessing or using the Services, or otherwise manifesting your assent to this Privacy Policy, you agree to be bound by this Privacy Policy and (1) if you are a Client, the Terms and Conditions, which together make up the Agreement, or (2) if you are a Talent Agency, the Agency Terms and Conditions, which together make up the Agreement, or (3) if you are a Talent, the Talent Terms and Conditions, which together make up the Agreement. If you do not agree to (or cannot comply with) all of the terms of this Privacy Policy or any other terms of the Agreement, you may not access or use the Services. Capitalized terms not defined in this Privacy Policy shall have the meaning set forth in our Terms and Conditions, or Agency Terms and Conditions, or Talent Terms and Conditions, which are incorporated herein, as applicable.
This Privacy Policy will help you understand the following:

Information We Collect From You

In the course of providing the Services and/or interacting with you, LÜK collects and/or receives the following types of information, which may include personal information.
Contact Information. We collect contact information through our Services, which typically includes name, address, email address, phone number, and any information provided in messages to us ("Contact Information"). We use Contact Information for purposes such as providing information about the Services, responding to your inquiries, sending you email alerts (including marketing emails), or providing the Services.
Account Registration Information. While you can visit and browse most of our Digital Properties without registering, some of our Services may require you to register for a Client Account or Agency Account or Talent Account (each, an "Account"), and create a profile. When you register for an Account as an individual, you will be required to provide us with certain information in addition to your Contact Information to create your personal profile and provide the Services to you. If you are registering for an Account on behalf of a business, we collect additional information, such as your business name, title, business description, business address, business email and phone, and other information used to create your business profile. You will be asked to select a username and password ("Credentials") to access and use the Services via your Account. We reserve the right to accept or reject any application to open an Account or any request to utilize the Services in our sole discretion.
Payment Information: In order to purchase the Services (or receive payment for Services rendered), you may be required to provide our third party payment processor(s) (currently, Stripe) ("each a "Payment Processor") with certain credit or debit card information, ACH transfer information or wiring instructions (collectively, the "Payment Information"). We do not obtain access to the Payment Information. Our Payment Processor(s) will collect on our behalf information about your payment for Services ("Transaction Information"). By using the Services, you acknowledge and agree that if and to the extent your Payment Information, Transaction Information, and/or any other information is collected by or transferred to Stripe or any other Payment Processor, such information will be governed by its applicable privacy policy, and that you expressly agree to the terms of such privacy policy. You hereby expressly grant us the right, power, and authority to access and transmit your information as reasonably necessary for the Payment Processor(s) to provide its services to you in connection with your use of our Services.
Your Content. When you use the Services, you may voluntarily provide us with additional information, such as photos or other images that you upload, Talent information, product information and descriptions, project or order quotes, project timelines, documents, and correspondence with LÜK.
Communications with LÜK. If you contact LÜK, either through our online platform, email or otherwise, we may keep your message, email address and contact information to respond to your request.
Location Information. If you are accessing the Services through a mobile device, you can choose to share your device's location with us in order to enable location-based features in the Services.
Other Information: You may voluntarily provide additional information to us by submitting content, entering a contest, promotion, or sweepstakes sponsored by us, completing surveys for marketing, research, or other purposes, or contacting us for additional information (using forms on our Digital Properties, via email or otherwise).

Information that we collect automatically

Log Data: When you use the Services, our servers automatically record information ("Log Data"), including information that your browser sends whenever you visit a Site. Log Data may also include your IP address, the address of the web pages you visited that had LÜK features, browser type and settings, the date and time of your request, how you used the Services, and cookie data.
Session Content: When you use the Services to connect with Clients and Agencies who list their products and services on LÜK's Platform, our servers automatically record conversations occurring on the LÜK Platform to ensure compliance with LÜK guidelines and for monitoring, supervision, and quality assurance and training purposes.
Cookie Data: When you access or use any of our Services, we use browser cookies, pixels, web server logs, web beacons, and similar technologies (collectively, "Tracking Technologies") to automatically collect or receive certain standard technical information and other data (such as traffic data, location data, logs and other communications data) sent to us by your computer, mobile device, tablet, or any other device over time on our Digital Properties, and your online activity across third party websites, apps, and devices, We may also evaluate your computer, mobile phone, or other access device to assist with problem detection and resolution, and to identify any malicious software or activity that may affect the availability of the Services.
When you access or use any of the Services, advertising companies, analytics networks and providers, and other third parties may also use Tracking Technologies to collect information about your online activities over time on our Digital Properties and across different websites, apps, online services, digital properties and devices.
The data we or third parties collect automatically is typically statistical data that may not identify you personally; however, we or third parties may maintain or associate it with personal information collected in other ways or received from third parties. We and third parties use this information to (i) personalize your experience with the Services, understand how you use the Services, maintain a persistent session, and improve and further develop our Services, and (ii) serve targeted and other advertising, and provide custom experiences, across other sites, apps, online services, digital properties and devices.
Cookies (browser cookies), a commonly used Tracking Technology, consist of small packets of data that a website or device stores on a browser, hard drive or device so that your device will "remember" information about your visit. In addition to collecting information, cookies are used to help us authenticate users, provide content of interest to you, analyze which features you use most frequently, and measure and optimize advertising and promotional effectiveness. To do this, we may use both session cookies, which expire once you close your web browser, and persistent cookies, which stay on your computer until you delete them. If you do not want cookies placed on your hard drive, you may be able to turn that feature off on your computer or mobile device. Please consult your internet browser's documentation for information on how to do this. If you decide not to accept cookies or other Tracking Technologies, the Services may not function properly.
Device Information: In addition to Log Data, we may also collect information about the device on which you are using the Services, including what type of device it is, what operating system you are using, device settings, unique device identifiers, and crash data. Whether we collect some or all of this information often depends on what type of device you're using and its settings.
Do Not Track: Your browser may support a "Do Not Track" option that can be selected in your browser settings, which sends a signal to websites you visit informing them that you do not want certain information about your visit to be collected. At this time we do not respond to browser "Do Not Track" signals, as we await the work of interested stakeholders and others to develop standards for how such signals should be interpreted.
Analytics and Usage: We use third-party analytics services (such as Google Analytics, etc.) to evaluate your access and use of the Services, compile reports on activity, collect demographic data, analyze performance metrics, and collect and evaluate other information relating to device and internet usage such as: the type of device, the advertising identifier, the operating system and version, carrier and network type; IP addresses (which may consist of a static or dynamic IP address and will sometimes point to a specific identifiable computer or device); browser type and language; referring and exit pages and URLs; date and time of access; the content viewed; the amount of time spent on particular pages; what features of the Services are used or visited; details of any purchases; click stream information; and precise geolocation data. These third party analytics services use cookies and other Tracking Technologies to collect, analyze and provide us with the data and related analytics. By accessing or using the Services, you consent to the processing of data about you by these analytics providers in the manner and for the purposes set out in this Privacy Policy. The information used by such analytics services is generally at the aggregate level.
We may add to or change these third-party analytics services from time to time. For more information on our analytics services, including how to opt out from certain data collection, please visit the sites below. Please be advised that if you opt out of any service, you may not be able to use the full functionality of the Services. If you have any questions, or to request a current list of our third-party analytics services, please contact us as set forth in Section XII ("How to Contact Us").

Information From Third Parties

Information from Other Services: You may give us permission to access your information in other services, and/or receive information regarding your professional experience and qualifications. The information we obtain from those services depends on your settings and their privacy policies.
Information from Quickbooks: When you use LÜK Pay, LÜK's payment processing feature facilitated by its Payment Processor(s) to satisfy payments for Services through the platform, you may decide to integrate your Quickbooks account with the Services. By doing so, you voluntarily give us permission to access your Quickbooks account which may contain personal information including, without limitation, your name, business name, email address, payment information, and social security number. Similar to information we receive from other third parties, the types of information that we have access to through your Quickbooks account will depend on your settings and their privacy policy, which is available at: https://www.intuit.com/privacy/.
Social Media: We maintain a presence on social media and other third party sites, including social media accounts, pages and related activities. We may collect personal information when you visit or use social media, including when you access our Services from social media. We will do so in accordance with the terms of use and privacy policies of those sites, apps and applicable law. This includes our social media pages on places like Facebook, Instagram, Twitter, and TikTok. For example, we may collect the information you shared on our social media pages through an application or form, which will have a link to this Privacy Policy. Personal information may also be collected by the third-party social media sites that host our social media pages. These sites may provide aggregate information and analysis to us about visitors' use of our social media pages. This allows us to better understand and analyze our user growth, general demographic information about the users of these pages, and interaction with the content that we post. Overall, this information may be used to help us understand the types of visitors and users of our social media pages and use of the content. This Privacy Policy does not cover personal information collected by such third party social media sites. Inferences: We may collect or receive inferences, which are assumptions or extrapolations that have been drawn from your information to create a profile which may include your preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities and aptitudes.
Text Messaging Program: This information includes your name, mobile phone number, and texting preferences (opt-ins and opt-outs). We use this information to send you text messages and manage our text messaging program. Please note that your mobile phone carrier may collect data about your wireless device usage, and that its practices are governed by the provider's own policies.

How We Use and Share Your Information

Services: We use the information we collect to deliver, support and improve the Services including, for example, to book and confirm talent for a job, to notify you about updates to the Services, monitor and test the Services, remember your login information, and contact you for marketing purposes.
Agents, Contractors and Service Providers. We may share your information with our agents, contractors or other service providers (e.g., payment processors; billing services; cloud providers) as needed to carry out the performance and functionality of the Services, fulfill your requests for authorized transactions, or provide user support.
Analytics and Usage. We may share user information in the aggregate with third parties, such as advertisers and other businesses. For example, we may disclose to a business the number of users that have viewed their product or may disclose to a professional how many times their profile has been viewed.
Third Party Ad Networks. We may use third party advertising companies to place advertisements on the Services or assist us in evaluating the effectiveness of our advertising, in accordance with applicable law. These companies may use cookies, web beacons or other tracking technology to collect information (not including your name, address or telephone number) about your visit to the Services and other sites and services in order to provide you with targeted advertisements. Affiliated Entities. We may share information from or about you with subsidiaries, joint ventures, or other companies under common control with LÜK, in which case, we require them to honor this Privacy Policy.
Business Transfers. If we are acquired by or merged with another entity, if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer the information we have collected about you to the acquiring company.
Research: We may disclose information about you to conduct research, plan projects, troubleshoot problems, and detect and protect against error, fraud, or criminal activity.
Security: We may disclose information about you to protect the safety and security of our Services, businesses and customers.
Comply with Applicable Law and Legal Process: We may disclose information about you to fulfill our legal and regulatory requirements, and to comply with applicable law, such as compliance with a subpoena, or similar legal process, and when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.
Other Uses and Disclosures: With your consent.

Children

In connection with providing the Services, we may receive personal information regarding children from our Clients and/or Agencies, each of whom has represented to us that its collection, processing, and transfer of such information to us for such purpose is pursuant to an informed parental consent.
The content on our Service is intended for adults and is not directed to children under 13. Except as set forth above, we do not knowingly collect personal information from or about children under 13. If you learn that a child under 13 has provided us with personal information without parental consent, please contact us at [email protected], and we will take steps to remove such information.

External Properties and Third Parties

Unless explicitly stated otherwise, our Privacy Policy addresses only our use and disclosure of information we collect from and/or about you in your interactions with LÜK and the Services. If you choose to disclose information to third parties, the use and disclosure restrictions contained in this Privacy Policy will not apply, as we do not control the privacy policies of such third parties, nor are we subject to them.
The Services may also contain hyperlinks to third-party websites, apps or advertisements ("External Properties") including, for example, opportunities to purchase third party products or services that are offered and provided by independent companies. If you click on a link for any External Properties, you will be redirected to a third party site. The information collected by such third parties or that you choose to provide, is governed by the third party site's privacy policy and practices. We have no control over the privacy policies or practices, the content, or the products and services, of any External Properties we provide or allow hyperlinks on our Services including but not limited to our business partners, advertisers, and sponsors. As such, we are not responsible for the content or the privacy policies of those External Properties. You should check the applicable third-party privacy policy and terms of use when visiting any External Properties.

Notice to California Residents

Pursuant to Section 1798.83 of the California Civil Code, residents of California have the right to obtain certain information about the types of personal information that companies with whom they have an established business relationship (and that are not otherwise exempt) have shared with third parties for direct marketing purposes during the preceding calendar year, including the names and addresses of those third parties, and examples of the types of services or products marketed by those third parties. Notice to Nevada Residents

We do not sell your personal information as defined under Nevada law. Nonetheless, if you are a resident of Nevada, you have the right to opt-out of the sale of certain personal information to third parties. You can exercise this right by contacting us at [email protected] with the subject line "Nevada Do Not Sell Request" and providing us with your name and the email address associated with your Account.

Notice to Non-U.S. Residents

The Services are operated in the United States. If you are located outside of the United States, please be aware that any information you provide to us will be transferred to the United States where the privacy laws may be different from those in your country of origin. If you are located outside the United States and choose to use the Services, you consent to any transfer and processing of your personal information in accordance with this Privacy Notice, and you do so at your own risk.

Accessing and Modifying Your Information; Email Communications

If you have an Account, we provide you with account settings and tools to access, correct, delete or modify the personal information you have provided to us and associated with your Account.
You cannot opt out of receiving transactional emails related to your Accounts. You may manage your receipt of marketing and non-transactional communications by clicking on the "unsubscribe" hyperlink located on the bottom of any of our marketing emails. We will use commercially reasonable efforts to process such requests in a timely manner. You should be aware, however, that it is not always possible to completely remove or modify information in our databases.
We will retain and use your information as necessary to comply with our legal and/or regulatory obligations, resolve disputes, and enforce our agreements.

How We Protect Your Information

We take commercially reasonable steps to protect your information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases, nor can we guarantee that the information you supply will not be intercepted while being transmitted to and from us over the Internet. In particular, email sent to or from the Services may not be secure, and you should therefore take special care in deciding what information you send to us via email.

We may change this Privacy Policy from time to time, and if we do, we will post any changes on this page. If you continue to use the Services after those changes are in effect, you agree to the revised Privacy Policy.
